8. Waiver

WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against Radiant Hot Yoga, LLC & Radiant On Demand LLC and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing Radiant Hot Yoga’s services, equipment and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

In consideration of gaining access to and/or being granted permission to participate in  yoga classes, other yoga classes and other activities associated with or given by or in connection with Radiant Hot Yoga, LLC (“RHY”)and Radiant OnDemand LLC and other good and valuable consideration, the receipt and sufficiency of which is confessed and acknowledged, I do hereby waive, release, disclaim, forgive and forever discharge RHY and Radiant On Demand and their respective owners, members, shareholders, partners, managers, directors, officers, agents, employees, heirs, representatives, executors, successors, assigns, legal representatives, staff, teachers and all others (collectively the “Released Parties”) from any and all known or unknown claims, demands, responsibilities, conditions, injuries, death, damages or liability resulting from and/or in connection with my participation in such yoga classes and other yoga classes and/or activities.

(1) I have been informed of and understand the policies and procedures set forth by RHY & Radiant On Demand other yoga classes and/or activity and, as a result, I voluntarily request to participate in this program of exercise.

(2) I acknowledge the existence of risk, both known and unknown, in connection with yoga classes, other yoga classes and/or other activities, including without limitation, (i) that  yoga classes are intensive physical exercise.(ii) that such  yoga classes, other yoga classes and/or other activities will include physical activity and/or exposure may be difficult and very strenuous and may cause or aggravate physical injuries and/or medical conditions up to and including death. I knowingly and expressly assume such risks (including unknown risks and/or risks which have not been expressly described to me), and agree to accept the responsibilities for any and all injuries or damages sustained, directly or indirectly, by, as a result of, or in connection with my participation in such yoga classes, yoga classes and/or other activities including, without limitation, those sustained or incurred via the use of RHY and Radiant On Demand  facilities and/or equipment. Most specifically, but without limitation, I acknowledge and accept responsibility for injuries or damages arising out of yoga classes, yoga classes and/or other activities that involve risk in any of the following areas: the use of equipment; the participation in group activities related to exercise, activity, yoga.

(3) In addition, I acknowledge that it was seriously recommended that I consult with a physician before engaging in any yoga classes, yoga classes and/or other activities associated with RHY and Raediant On Demand.

(4) I represent and warrant to RHY & Radiant On Demand  that I (i) have been examined by a physician within the last six months and have been found to be in good physical health, (ii) have no condition or injury which would negatively impact my full participation in  yoga classes, yoga classes and/or other activities, and (iii)  yoga and/or other exercises I am to learn and perform during my participation in classes and/or activities offered by RHY and Radiant OnDemand.

(5) I will follow the instructions given by my instructors. Any deviation from those directions is at my own risk. I acknowledge that I should (i) avoid all alcohol and/or drug (including legal drugs) use, stimulants and/or pain medication, and (ii) eat and hydrate properly (including hydration during classes or activities), while participating and prior to participating in yoga classes, yoga classes and/or other activities.

HAVING READ THE PRECEDING, I ACKNOWLEDGE FULL UNDERSTANDING OF THE WAIVERS, RELEASES AND RISKS DESCRIBED AND/OR SET FOR THE HEREIN AND KNOWINGLY AGREE TO ACCEPT FULL RESPONSIBILITY FOR MY EXPOSURE TO SUCH RISKS AND TO FULLY WAIVE, RELEASE, DISCLAIM AND FOREVER DISCHARGE EACH OF THE RELEASED PARTIES FROM ANY AND ALL KNOWN AND UNKNOWN CLAIMS, DEMANDS, RESPONSIBILITIES, CONDITIONS, INJURIES, DAMAGES AND/OR LIABILITY RESULTING FROM AND/OR IN-CONNECTION WITH MY PARTICIPATION IN SUCH  YOGA CLASSES, OTHER YOGA CLASSES AND/OR OTHER ACTIVITIES.
